O presente trabalho visa analisar a questão dos pronunciamentos judiciais ilegítimos, dada a compreensão e função da jurisdição constitucional, no bojo das formas de controle de constitucionalidade e da vinculação das decisões judiciais. Apresenta-se a tensão que isto pode trazer para a manutenção da Constituição, seus princípios e a segurança da ordem jurídica do Estado. A metodologia utilizada foi a teórica bibliográfica.

‘Interactional expertise’ is developed through linguistic interaction without full scale practical immersion in a culture. Interactional expertise is the medium of communication in peer review in science, in review committees, and in interdisciplinary projects. It is also the medium of specialist journalists and of interpretative methods in the social sciences. We describe imitation game experiments designed to make concrete the idea of interactional expertise. The experiments show that the linguistic performance of those well socialized in the language of a specialist (...) group is indistinguishable from those with full blown practical socialization but distinguishable from those who are not well socialized. The imitation game can also be used to indicate whether an individual can enter an esoteric domain and master the interactional expertise, a skill required by interpretative sociologists of science, anthropologists, ethnographers, and the like.Keywords: Expertise; Interactional expertise; Imitation game; Turing test; Colour blindness; Interpretative methods. The main aim of this article is to offer a sociological concept of crisis that, defined as the expected yet non-lineal outcome of the internal dynamics of modern societies, builds on the synergies between critical theory and systems theory. It contends that, notwithstanding important differences, both traditions concur in addressing crises as a form of self-reproduction of social systems as much as a form of engagement with the complexities and effects of such processes of reproduction. In order to make our (...) comparison exhaustive, this article explores critical and systems theories’ notions of crisis at three levels: (1) their conceptual delimitation of crises; (2) their methodological proposals to empirically observe crises; and (3) their normative attempts to contribute to their resolution. As crises remain a distinctive structural feature of the social world and a rich source of knowledge about it, reflexivity must be seen as a crucial form of engagement with the negative expressions of social life itself. A real but typical case of identity fraud is used to open up the complex web of identification systems in Brazil. It is argued that identification has two poles related to the nature of citizenship—repression and inclusion—and that reactions from citizens to new identification schemes can be attributed to how they view the purpose of the cards in these terms. In Brazil, a sense of inclusion and citizenship based on a fear of anonymity and exclusion predominates leading to widespread support (...) amongst even critics of state activities. However, this may be undermined by the lack of state preparation for an information society, particularly the absence of meaningful data protection laws. (shrink)

In his 1982 book Wittgenstein On Rules and Private Language, Saul Kripke maintains that Wittgenstein´s rule following considerations land us with a skeptical argument about meaning. This essay contains a short exposition of Kripke´s argument. In addition, I hold, both on textual grounds and by an appeal to some select secondary literature, that Wittgenstein offered no such skeptical argument in the Philosophical Investigations . Although Wittgenstein certainly repudiates a view of meaning based on temporally located mental states, it does not (...) follow that there can be no meaning-grounding facts of other sorts. Although it is true that mental states, viewed atomistically, offer no sure foundation for meaning, I argue that it need not follow, pace Kripke, that no facts about an individual´s past mental life can ever make it clear that he meant ‘plus’ rather than ‘quus’ while performing any addition. For the individual´s past mental life is indeed relevant to meaning when considered in its unfolding in time. The essay further contains explorations on the very nature of the practice of following a rule and ends with a discussion of the solitary rule follower. (shrink)

O domínio persistente das elites políticas no âmbito de diferentes governos representativos contemporâneos, aliado à descaracterização da natureza programática dos partidos políticos têm levado a uma intensa reflexão, nos últimos anos, acerca dos limites e capacidades da democracia como sistema de governo. Problemas como a persistência de profundas desigualdades sociais e a incapacidade de inclusão das minorias – e até mesmo de maiorias, como no caso brasileiro – apontam para um processo de “oligarquização” das democracias, marcado por uma tentativa de (...) “neutralização política do povo”, em todo incompatível com os valores republicanos e democráticos. Em um caso de tamanha sub-representação, no qual setores majoritários da sociedade são governados sistematicamente por setores minoritários, como garantir que o ideal de não-dominação seja assegurado? Partindo da constatação dos limites práticos dos governos representativos contemporâneos em geral, e do caso brasileiro, em particular, o propósito deste artigo é debater em que medida a proposta de “democracia aberta” de Hélène Landemore, que propõe a recuperação da prática do sorteio como expressão do elemento democrático, é compatível com o pensamento republicano. No presente artigo, procuramos mostrar, por intermédio de numerosos exemplos, que a distinção lógica operada por Pierre Duhem entre a física e a metafísica não impossibilita que, do ponto de vista histórico, o autor reconheça a existência de um entrosamento profícuo a cingir as duas áreas do saber. Distinguimos três níveis possíveis de interação entre a física e a metafísica, porque acreditamos que ele aceita (a) que o físico trabalha constantemente movido por ambições metafísicas não autorizadas pela rigorosa lógica, (b) (...) que os sistemas metafísicos contribuíram para muitos dos progressos das teorias físicas, em especial, para o nascimento da ciência moderna e (c) que podemos identificar tradições metafísicas de pesquisa duradouras que se mostraram mais férteis do que algumas tradições positivas. In this article, we aim to show, by means of several examples, that Pierre Duhem's logical distinction operated by Pierre Duhem between physics and metaphysics does not prevent him, from a historical perspective, recognizing that there can be a fruitful interplay between the two fields of knowledge. We distinguish three possible levels of interaction that we believe Duhem accepts between physics and metaphysics: (a) that the physicist works constantly moved by metaphysical ambitions not authorized by rigorous logic; (b) that the metaphysical systems have contributed to the progress of many physical theories and, especially, to the birth of modern science, and; (c) that we can identify long-lasting metaphysical traditions of research which have shown themselves to be more fertile than the positivist traditions. A partir de los años 90, la información estadística da cuenta de una masiva llegada de inmigrantes peruanos a la Región Metropolitana, concentrándose principalmente en las comunas de Santiago, Recoleta e Independencia. En este artículo se busca entender el efecto de los inmigrantes como factor de cambio en las áreas centrales de la capital, desde las transformaciones socio-espaciales, las que modifican el territorio, como el comportamiento de la población –evolución y distribución espacial-, y los cambios en la morfología y estructura (...) de éste. Lo anterior tiene sentido sobre la base teórica de la Nueva Geografía de las Migraciones, la cual explica el problema migratorio en el contexto de la Globalización y como ésta origina nuevos polos de atracción para la localización de esta población. Finalmente, se evalúan las condiciones de vida objetiva y percibida de los inmigrantes peruanos en cuanto a la calidad de vida y de satisfacción residencial. (shrink)

Hace dos décadas se incorporó a la agenda pública el interés por el embarazo adolescente en tanto expresión de la pobreza y la vulnerabilidad de la población femenina juvenil. Este artículo presenta un análisis integral del problema a través de cuatro entradas: 1) un breve panorama de las políticas públicas adoptadas en estas dos décadas y diagnóstico que les dio origen; 2) profundiza en la magnitud del embarazo de mujeres menores de 20 años (a partir de datos sobre embarazadas y (...) no del número de hijos nacidos vivos de madres) y compara tres registros: 1995-1996 -Censo de alumnas embarazadas en el sistema escolar, MINEDUC-; 2006 y 2009 -CASEN, registro de menores de 20 años embarazadas-; 3) Profundiza en las vulnerabilidades de estas jóvenes a partir de testimonios sobre el sentido y ejercicio de la sexualidad en la experiencia juvenil; 4) Plantea que la condición de madre adolescente conlleva la vulnerabilidad a mayores condiciones de pobreza, y de exclusión a derechos y beneficios otorgados por el sistema educacional, fundamentándolo en el análisis de las bases de datos de la CASEN 2006 y 2009. This study analyses the emotional exhaustion of students inhigher education, derived from the extremely technology-relatedstrain associated to the current COVID-19 pandemic in a conservation of resources’ approach. Technostress, as source of emotional exhaustion, was investigated in a sample of 333 students in a medium size public university in Spain. Data was collected in May 2020, during the COVID lockdown. After literature review, a structural model was developed, linking technostress with emotional exhaustion. Results confirm the expected cause-effect relationships. In addition, the (...) study reveals two mediator variables that must be considered when managing students′ suffering, perceived stress and intrapersonal conflicts. This study contributes to the academic literature in the field of managing and mitigating suffering. They do so by providing both new knowledge and empirical evidence on the effects of technostress in the new generations that will soon join the working life. (shrink)

Neste trabalho, pretendemos avaliar criticamente algumas das teses de John McDowellsobre a natureza da virtude, tal como expostas em seu artigo “Virtue and Reason” e, ao fazê-lo,expor algumas de suas limitações. Mais especificamente, tratarei o que vejo como problemas emsua apresentação da virtude como uma forma de conhecimento, e sua proposta – corporificada natese da unidade das virtudes – de que as virtudes comumente reconhecidas deveriam ser vistascomo manifestações parciais da virtude enquanto tal. Também enfocarei a assertiva de McDowellde que (...) o conhecimento que constitui a virtude não pode ser visto como tendo um conteúdoproposicional que se preste a uma codificação em princípios de conduta – a tese de nãocodificabilidade– e a relação da postura pessoal de McDowell com a empreitada mais ampla daética de virtudes. In a seminal work, Tversky and Kahneman showed that in some contexts people tend to believe that a conjunction of events (e.g., Linda is a bank teller and is active in the feminist movement) is more likely to occur than one of the conjuncts (e.g., Linda is a bank teller). This belief violates the conjunction rule in probability theory. Tversky and Kahneman called this phenomenon the “conjunction fallacy”. Since the discovery of the phenomenon in 1983, researchers in psychology and philosophy (...) have engaged in important controversies around the conjunction fallacy. The goal of this paper is to explore the most important of these controversies, namely, the controversy about the nature of the conjunction fallacy. Is the conjunction fallacy mainly due to a misunderstanding of the problem by participants (misunderstanding hypothesis) or is it mainly due to a genuine reasoning bias (reasoning bias hypothesis)? A substantial portion of research on the topic has been directed to test the misunderstanding hypothesis. I review this literature and argue that a stronger case can be made against the misunderstanding hypothesis. Thus, I indirectly provide support for the reasoning bias hypothesis. (shrink)

Neste artigo, pretendo examinar algumas passagens de Categorias 7 que possam lançar alguma luz sobre o estatuto que Aristóte- les confere às atribuições relativas, visando melhor precisar as razões que o teriam conduzido a negligenciar (...) um tratamento formal mais rigoroso das proposições relacionais nos Primeiros Analíticos. Saul Kripke argued that the requirement that knowledge eliminate all possibilities of error leads to dogmatism . According to this view, the dogmatism puzzle arises because of a requirement on knowledge that is too strong. The paper argues that dogmatism can be avoided even if we hold on to the strong requirement on knowledge. I show how the argument for dogmatism can be blocked and I argue that the only other approach to the puzzle in the literature is mistaken.

Christine Tappolet’s book Philosophy of Emotion: A contemporary introduction, and many other works in emotion theory, focus primarily on emotional episodes at the expense of so-called “emotional dispositions.” I argue that there are no reasons for theories of emotion to focus on emotional episodes, or to reserve the term “emotion” for emotional episodes.

In “Is Justified True Belief Knowledge?” Edmund Gettier (1963) attacked the thesis ‘S knows that P iff P is true, S believes that P, and S is justified in believing that P’. His intention was to sustain that someone can have a justified true belief without knowing that belief. He made that by creating two counter-examples to that thesis. In this article, I try to show that Gettier’s arguments are based in a weak account of justification, and that such a (...) weak view cannot talk about someone knowing something. I begin by presenting his counter-examples, and then I show they do not work. (shrink)

The aim of the present paper is to provide a robust classification of valid sentences in set theory by means of existence and related notions and, in this way, to capture similarities and dissimilarities among the axioms of set theory. In order to achieve this, precise definitions for the notions of productive and nonproductive assertions, constructive and nonconstructive productive assertions, and conditional and unconditional productive assertions, among others, will be presented. These definitions constitute the result of a semantical analysis of (...) the notions involved. The conceptual clarification developed here results in a classification of valid sentences of set theory that goes against the standard view that extensionality is not an existence assertion. Em diversas ocasiões, Leibniz recorre à autoridade de Aristóteles a fim de roborar sua tese da verdade como inerência do predicado ao sujeito da proposição. Não é, contudo, evidente em que medida a filosofia aristotélica poderia oferecer amparo a essa reivindica- ção. Afinal, a Aristóteles tradicionalmente se atribui uma concepção de verdade diferente, consistente em uma relação de correspondência entre a proposição e a realidade que ela se destina a descrever. Sem discutir a conhecida tese da verdade como correspondência, este (...) trabalho é dedicado a investigar em que medida os escritos de Aristóteles permitem que Leibniz respalde neles as suas afirmações. Para tanto, a presente investigação estará focada nos Primeiros e os Segundos Analíticos, obras em que Aristóteles expõe sua teoria do racio- cínio e da demonstração. Visa-se averiguar se, e sob que condições, a noção de inerência ali mobilizada pode ser assimilada à noção leibniziana de inerência. (shrink)

El presente artículo busca enfocar la correlación entre el uso de la energía, el espacio, el territorio y el desarrollo local, teniendo en cuenta la utilización del gas natural en las cerámicas de Mato Grosso del Sur/Brasil. La importancia de los hechos geográficos es pautada por muchos parámetros, como el paso del tiempo, los nuevos descubrimientos tecnológicos, las necesidades de materias primas, los objetivos nacionales e internacionales y la ética de las relaciones internacionales. El gas natural no es utilizado aún (...) como fuente alternativa de energía en gran escala en el Estado. Puede ser considerado como uno de los resultados de la valorización de la política socio económica, de la cultura local y del medio ambiente preservado como parte de la identidad local del ser humano al mejorar su calidad de vida. If we want to say what “fundamentality” means, we have to start by approaching what we generally see at the empty place of the predicate “____ is fundamental”. We generally talk about fundamental entities and fundamental theories. At this article, I tried to make a metaphysical approach of what is for something to be fundamental, and I also tried to talk a little bit of fundamental incomplete and complete theories. To do that, I start stating the notion of “entity” and (...) looking at the difference at perceived entities. The difference led us to talk about the entities’ structures and their powers, and about the supervenience between these last two. The supervenience talk made us to see the fight between emergentism and reductionism as the difference between the irreducibility of laws and the reducibility of powers and structures to lower-order domains. Then, we conclude that “fundamentality” is a mereological relation – a relation that a whole structure has to a certain combination of its structural parts or that a power has to a certain combination of its constituent powers – of to be identical and to exist in virtue of them. This paper discusses there is no sustainable theoretical alternative for building knowledge without principles including cooperation –aimed at the preparation and distribution of beliefs– among individuals. This principle helps to conceive both the relation among internalist and externalist theories, and a cognitive explanation based on the concept of epistemic warrant. The concluding remark is that concepts, like evidence or reliability, can only be conceived as skills of subjects belonging to a community.

The 'Gettier Problem' has been central to epistemology since 1963, when Edmund Gettier presented a powerful challenge to the standard analysis of knowledge. Now twenty-six leading philosophers examine the issues that arise from Gettier's challenge, setting the agenda for future work on the central problem of epistemology.

Honneth afirma que o léxico das palavras diagnóstico e patologia estão ligadas à medicina. Na área social, essas noções só podem ser interpretadas indiretamente, ou seja, através das narrativas literárias, do campo artístico e da cinematografia. O Observatório Global de Patologias Sociais propõe-se a superar esse déficit. Este artigo exibe não apenas a análise conceitual, mas também as percepções inovadoras oriundas de um questionário online. Foram três questões. Por um lado, trata-se de descrever uma conceptualização de patologia social. Por outro, (...) coletar sugestões para um instrumento empírico. Por fim, obter uma lista de patologias sociais. A análise demonstrou que há patologias restritas ao âmbito individual, enquanto outras são concernentes ao espaço coletivo. Nesse sentido, os efeitos e acometimentos também obedecem a categorias diferenciadas. Além do mais, aparecem percepções de patologias ligadas ao aspecto institucional, revelando uma preocupação com relação ao sistema social. Como conclusão, o texto sugere que a análise das patologias deve voltar-se à concretização social, institucional e histórica. Deste modo, os impulsos que, a princípio, eram tratados como subjetivos, individuais ou pessoais podem ser investigados como situações sociais coletivas e institucionais. (shrink)

This article attempts to read the very concept of reading as articulated and problematized by Derrida’s newly discovered Geschlecht III. I argue that Derrida enacts a reading of Heidegger in Geschlecht III in ways that help us understand the strong sense Derrida gives this word. In the article’s first part, I dwell on Derrida’s—and Heidegger’s—methodological precautions that problematize the traditional concept of reading so as to open the way for a reading of Heidegger that does not bank on the metaphysical (...) presuppositions the very same Heidegger warns us against time and again. In the second part, I turn to Derrida’s topotypological examples that show us what traditional methodology problematically presupposes when “reading” Heidegger. The article ends by turning to the Derridean notion of “overprinting”—and the uncanny effects of doubling it implies—as a way to think about what it means to read and countersign Heidegger’s text. This article presents an interpretation of Cyrus’ psychology in Xenophon'sCyropaedia. Its point is that Cyrus’ psychological structure is composed by a set of three desires (philotimía, philanthrōpía, philomátheia) given by nature and a set of virtues (sōphrosúnēandenkráteia) acquired by education. The paper will argue that Cyrus, as an enkratic ruler, does not long for any kind of honours, but is guided by truephilotimía, that is, the desire for true honours—honours freely given by gratitude or admiration.philanthrōpíais the key to achieve these (...) honours, since it naturally prompts a benevolent and generous behaviour. At the same time,philomátheiaprovides the desire of knowledge necessary to acquire the techniques in order to accomplish ambitious and philanthropic deeds. Therefore, confronting those who have posed negative interpretations of Cyrus, the article will argue that the uncommon combination of these psychological predispositions makes Cyrus a virtuous and effective ruler. According to Kemp Smith, Descartes believed that animals were devoid of feelings and sensations. This is the so-called ‘monstrous thesis,’ which I explore here in light of two Cartesian approaches to animals. Firstly, I examine their original treatment in function of Descartes’ early metaphysical approach, i.e., all natural phenomena are to be elucidated in terms of mental scrutiny. As pain would only exist in the understanding, and animals have neither understanding nor souls, Descartes held that they did not suffer. Secondly, (...) I look at the Cartesian late naturalism; specifically, at how animals are subsequently regarded as machines that may suffer. Lastly, I conclude that the ‘monstrous thesis’ is not Cartesian because animals are machines with feelings and sensations. However, Descartes’ surprising indulgence towards humans who kill and eat animals supposes that empathy for beings who may suffer is not necessary. This may raise doubts as to another ‘monstrous thesis.'. (shrink)

This paper begins the study of first-order functions, which are a generalization of truth-functions. The concepts of truth-table and systems of truth-functions, both introduced in propositional logic by Post, are also generalized and studied in the quantificational setting. The general facts about these concepts are given in the first five sections, and constitute a “general theory” of first-order functions. The central theme of this paper is the relation of definition among notions expressed by formulas of first-order logic. We emphasize that (...) logic is not concerned only with the consequence relation among notions expressed by formulas. It also attends to the relation of definition among notions, where a notion is defined from other notions. Sections 5 and 6 deal exclusively with the relation of definition among notions expressed by formulas of first-order logic. In these sections, we study the systems of first-order functions, which are the sets of first-order functions closed under definitions. Sections 7 and 8 are concerned with the relativization of first-order functions to a class of structures. The relativization to a class of structures is a fundamental operation which is used in order to relate the theory of first-order functions with set theory and first-order model theory, a subject which we have barely scratched the surface. The apparatus developed in this paper enables us to define what is a vehicle for the foundation of classical mathematics in set theory, and, in Sect. 8, we prove that first-order logic with one binary predicate variable is not a minimal vehicle for the foundation of classical mathematics in set theory. Sections 9 and 10 introduce further operations and ideals of first-order functions. Besides some results on the influence of the arguments of a first-order function, a result about definability is proved in Sect. 10.1. It is this theorem that provides necessary and sufficient conditions for a first-order function to be in a finitely generated ideal. In Sect. 11, this result is applied to the problem of predicate definability in classes of structures, the problem with which Beth’s theorem dealt in the case of elementary classes. (shrink)

A fundamentação filosófica permeada na obra literária do Marquês de Sade está intimamente ligada às teses materialistas, em especial, às obras dos filósofos E. de Condillac e La Mettrie que exerceram tamanha influência sob o Marquês. Nos diálogos dos personagens de Sade, encontramos o desmembramento radical das teses propostas por La Metrrie, em principal, quando adere a uma fisiologia muscular, na qual está relacionada a noções de irritabilidade muscular e de sensibilidade nervosa, bem como a tese central de Condillac, quando (...) explica a natureza humana a partir do prazer e do desprazer, principalmente no que tange ao detalhamento das sensações como responsáveis pela composição de faculdades como a atenção, a memória, a imaginação e o juízo. Ao radicalizar, Sade transita por um caminho obscuro da natureza humana guiado unicamente por um prazer sexual egoísta. Sade se apropria do conceito de Estado de Natureza proposto por Thomas Hobbes para justificar a conduta libertina, porém diferente de Hobbes que reconhece no Estado de Natureza a necessidade da constituição do Estado representado por um soberano para coordenar a ordem em favor da vida de cada indivíduo, Sade, por sua vez, ao reconhecer o Estado de Natureza, onde perdura a guerra de todos contra todos, identifica a predominância da lei do mais forte. A figura do soberano libertino se apresenta para constituir a organização social denominada Orgia, cujos indivíduos adeptos reconhecem-no como o mais forte, e assim, submetem-se ao seu domínio por possuírem algo em comum: a busca de um grau elevado de prazer. Samba is Rio de Janeiro’s most powerful form of artistic expression, but also one of the city’s main clichés. It is a cliché of "national identity", cliché for the people and for the Nation State. However, more fundamental than its capture in these clichés, making it powerless, samba is a line of flight or - even better than that - it is a series of lines of flight, according to the different modes by which it has been reinvented throughout the (...) 20th century. Samba draws Rio’s map, with its sections and territorial occupations : shaping territories and being shaped by them, inventing bodies according to their performances. The performances go against asepsis, physical disciplines, and the separation that one tries to inflict on the city’s territories. Este artigo possui a finalidade de apresentar as correlações entre a filosofia como forma de vida e as insurreições dos governados a partir de uma leitura foucualtiana em torno da ontologia histórica de nós mesmos. Num primeiro momento, procura-se estabelecer uma leitura acerca da problematização empreendida por Foucault em torno da biopolítica compreendida como governo da vida na nossa modernidade a partir da formação de certos dispositivos de controle e de assujeitamentos através da articulação entre as estratégias de saber, das (...) práticas de poder e dos processos de subjetivação. Já o segundo momento é dedicado a pensar os traços fundamentais da parresía como prática aletúrgica de uma manifestação cínica do escândalo da verdade. As considerações finais são dedicadas a pensar, a partir de Foucault, as experiências éticas a partir de uma dimensão ontológica cuja atitude é a sublevação de forças necessárias para a produção de novas práticas de liberdade.
